Controversial Legal Issues – Tort Reform

One of the most hotly debated legal issues of our time is tort reform. Tort is defined as “… a wrongful act, not including breach of contract or trust, that results in injury to another’s person, property, reputation, or the like, and for which the injured party is entitled to some compensation.” In other words, if someone harms someone else, then they should pay up for it. Tort litigation is so contentious, that Congress has been and continues to debate reform issues.

Adversaries say that existing tort litigation raises the cost loads of medical care and insurance and puts them on the taxpayer’s backs. They say that likelihood of frivolous lawsuits would diminish, thus reducing costs of insurance and medical care if tort reform passed. Supporters of the existing system disagree, but since the economy and spending is under such examination, tort reform has persisted to be a hot topic.

Tort reform advocates are proposing procedural limits on the ability to file claims as well as capping limits of damage awards. Foes of the current tort system say it is nothing more than a form of corporate welfare. As the United States Congress vigorously debates the health care issues at hand, both sides of the isle see a necessity to look at ways to lower health care costs and lower the deficit, but finding that balance between legitimate accountability against harm and frivolous lawsuits has been difficult.

Advocates of the current tort system argue that it is misinterpreted and void of any factual evidence to support the necessity of reform. They quote multiple cases when a person has been harmed and through no fault of their own and at the hands of someone else, can’t maintain the life afforded to them before the damage occurred. Advocates of the current system say that the harmed person should be monetarily reinstated to the same position they would have been had they not been damaged.
